Health Care Legal Team
Assistant General Counsel, Thomas Gilevich (A)
The Health Care Legal Team focuses its efforts in matters related to inmate health care: from Keyhea hearings to coordination with the Attorney General’s (AG) office on class actions related to heath care in the adult and juvenile institutions. In addition, the Health Care Team coordinates with the AG’s office on inmate habeas petitions involving correctional health care.
The Health Care Legal Team’s active involvement during all aspects of class action matters concerning healthcare will encourage prompt identification of potential concerns and facilitate mitigation efforts early in the litigation. The Health Care Legal Team’s post-litigation oversight will also assure prompt disposition of matters subject to remedial plans or other court imposed monitoring at the conclusion of the litigation.
Keyhea Hearings
The Health Care Legal Team is responsible for ensuring that the procedural requirements of a permanent court injunction in the California case of Keyhea v. Rushen, 178 Cal.App.3d 526 (1986) are followed. The injunction, now codified by reference into Penal Code § 2600, outlines specific due process requirements that must be followed for the involuntary administration of psychotropic medications to mentally ill inmates who are dangerous to themselves or others, or are unable to care for themselves.
