Chapter 3, Article 2 and Article 4
NCDOM #08-01

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding the new DOM policy for Limited Term Light Duty Assignments (LTLDA) in new DOM Article 4 of Chapter 3, Employeee Wellness Programs. This revision has been developed to provide operational policy in support of the California Code of Regulations, Title 15, Section 3436, LTLDA. This revision provides operational instructions needed for standardized procedures in the field. Additionally, Chapter 3, Article 2, Health and Safety Program, has been revised to remove references to LTLDA and refers the reader to Chapter 3, Article 4.


Chapter 5, Article 47
NCDOM #08-02

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding the adoption of a new article within Chapter 5, specifically, Article 47, Integrated Housing. This new Article has been developed in response to litigation challenging the Department’s policy of using race as the primary factor in housing its inmate population. This case has been reviewed by the United States Supreme Court, who remanded it back to the California Court of Appeals to apply a “strict scrutiny” standard to the Department’s housing policy. To avoid further litigation, the Department negotiated a settlement agreement with plaintiffs to achieve as high a degree of integrated inmate housing as can be safely achieved throughout the state. A companion package that revised the Title 15 regulations to authorize the implementation of this policy has been approved and adopted.


Chapter 7, Article 10
NCDOM #08-03

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding amendment to Chapter 7, Article 10. This article has been revised to incorporate a legacy Administrative Bulletin (AB) 95-06, Inmate Name Change Procedures. This AB announced the implementation of Assembly Bill 2782 (1994), which amended Section 1279.5 of the Code of Civil Procedure. Revisions to this DOM Article also include updated references to organizational division names and position titles. All other content remains the same since the last revision of June, 1995.


Chapter 5, Article 21
NCDOM #08-04

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 5, Article 21, regarding Inmate Use of Telephones. Specific modifications were made to delete and/or correct outdated language and based on the recommendation by the Office of the Inspector General (OIG) in regards to a confidential phone call that was granted between an attorney and inmate without following proper procedure. This revision is necessary to specify and standardize the process that an attorney must complete in order to receive approval for a confidential phone call with an inmate.


Chapter 1, Article 6
NCDOM #08-05

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 1, Article 6, regarding Regulation and Policy Directives. The content of this article, last revised in January of 1990, incorporates the following three legacy Administrative Bulletins (AB):

  • AB 92-4, Agreement between CCPOA and Department of Corrections allowing access to DOM Subchapter 55000, issued February 7, 1992.
  • AB 94-1, Establishment of the Forms Management Functions within Central Office, issued February 4, 1994.
  • AB 96-3, Approval of Department Operations Manual and Bulletins, issued March 28, 1996.


Chapter 3, Article 7, Section 31070.9
NCDOM #08-06

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 3, Article 7, specifically the adoption of Section 31070.9 regarding Retired Peace Officers Concealed Weapons Endorsement. This section is being adopted to incorporate a legacy Administrative Bulletin (AB) 02/06 - Retired Peace Officers Concealed Weapon Permit. The AB references Penal Code (PC) Sections 12027, 12027.1 and 12031 as authority to allow honorably retired peace officers, who meet the training requirement in PC 832, to carry a concealed weapon. This document also announces the revision of CDCR Forms 1051, 1052, 1053 and 1054. In addition, a new CDCR Form 2164 (03/08), Live Scan Response Form DOJ/FBI/Firearms has been created to correspond with the revised CDCR forms and is to be used in conjunction with the endorsement process outlined in this DOM revision.


Chapter 1, Article 1, Section 11010.6.3
NCDOM #08-07

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 1, Article 1, Section 11010.6.3, Office of Internal Affairs. Specific modifications were made to delete all text in Section 11010.6.3 and replace the text in its entirety with updated language which has been rewritten for clarity and easier reference.


Chapter 3, Article 1
NCDOM #08-08

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 3, Article 1, Equal Employment Opportunity. The content of this Article, last revised in February of 1990, contains extensive updates, and incorporates or retires policies implemented through the following legacy Administrative Bulletins:

Chapter 3, Article 21, Section 33020.16
NCDOM #08-09

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 3, Article 21, regarding Uniforms/Employee Grooming Standards, specifically, Section 33020.16, Protective Vests. The initial adoption for this policy, NCDOM #07/08 dated May 27,2007 was superseded by Administrative Bulletin (AB) 07-01 dated June 22, 2007 pending notification of and potential discussions with Bargaining Unit 6. This document, NCDOM 08-09, incorporates and supersedes both NCDOM 07-08 and AB 07-01 and will serve as the official policy listed in DOM with an effective date of 5/21/2008.

Chapter 5, Article 43, Sections 54030.17 - 54030.21.7.2
NCDOM #08-10

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding the attached amendment to Chapter 5, Article 43, Sections 54030.17 - 54030.21.7.2, Inmate Property - Authorized Personal Property Schedule (APPS). The APPS, last revised in August of 2007, is incorporated by reference into the recently revised California Code of Regulations, Title 15, Sections 3190 and 3191, which was permanently adopted on June 4, 2008.


Chapter 1, Article 26
NCDOM #08-11

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding the attached amendment to Chapter 1, Article 26, American Correctional Association (ACA) Standards. This DOM article addresses the Department's relationship with the ACA in the event the Department pursues ACA accreditation of selected facilities as determined by the Secretary.


Chapter 5, Article 41
NCDOM #08-12

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding revisions to Chapter 5, Article 41, Inmate Mail. This revised Article has been developed to align the Department's mail policy with recently adopted department regulations governing Inmate Mail and Publications, and with current United States Postal Service regulations.


Chapter 3, Article 3
NCDOM #08-13

The purpose of this document is to provide all Department Operations Manual (DOM) holders with information regarding the revision to Chapter 3, Article 3, Employee Awards Program. This revised DOM Article provides standards and procedures for participation in the State Merit Award Program, Employee Recognition Program, Safety Awards Program, and 25-Year Service and Retirement Recognition Program.


Chapter 5, Article 19
NCDOM #08-14

The purpose of this document is to provide Department Operations Manual (DOM) holders with information regarding revision to Chapter 5, Article 19, Arrest, Search and Seizure.  This article is being adopted to incorporate a legacy Administrative Bulletin (AB) 05/01, Clothed Body Searches of Female Inmates.  In addition to AB 05/01, a new section titled Contraband Surveillance Watch has been developed and incorporated to replace Quarantine.  Where appropriate, search standards have been changed to “Reasonable Suspicion” and a definition for the standard has been added.  A section describing Peace Officer Authority has been removed and will be expanded and adopted as a new Article in the near future.   


Chapter 5, Article 7
NCDOM #08-15

The purpose of this document is to provide Department Operations Manual (DOM) holders with information regarding revisions to Chapter 5, Article 7, concerning Inmate Deaths, Serious Injury or Illness Notification. Specific modifications were made to delete and/or correct outdated language in the article which includes the incorporation of legacy Administrative Bulletin 94/4, dated March 7, 1994. Additionally, language was added at the request of the Receiver's office detailing the procedure regarding death reporting and review as part of the Plata policies and procedures.


Chapter 5, Article 40
NCDOM #08-16

The purpose of this document is to provide Department Operations Manual (DOM) holders with information regarding revision to Chapter 5, Article 40 regarding Joint Venture.  Article 40 has been revised to incorporate recent revisions to the California Code of Regulations, Title 15, Subchapter 5, Article 9, Joint Venture Program into the policy of the DOM.


Chapter 1, Article 18
NCDOM #08-17

The purpose of this document is to provide Department Operations Manual (DOM) holders with information regarding revision to Chapter 1, Article 18 regarding Legal Matters.  Article 18 has been revised to incorporate and retire Administrative Bulletin (AB) 08-05, Supplemental Inmate Identification for Notary Services, resulting from a recent law change in Civil Code 1185 regarding acceptable means of identification for notary services.


Chapter 7, Article 17
NCDOM #08-18

The purpose of this document is to provide Department Operations Manual (DOM) holders with information regarding revision to Chapter 7, Article 17 concerning Preparation of Calendars. Section 74040.3.6, 10 Days Prior to Hearing, has been revised to provide direction and policy for delivering Psychiatric/Psychological reports to offenders prior to the life parole consideration hearings. Division names and position titles made obsolete by the Department’s reorganization were also updated. In addition, grammatical and punctuation changes are also made for consistency and to meet departmental standards.
