class=\"wp-block-heading\"><strong>EDITED TASK LISTING<\/strong><\/h2>\n\n\n\n<p><strong><em>NOTE:\nEach position within this classification may perform some or all of these\ntasks. <\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Task Statements: <\/em><\/strong><\/h3>\n\n\n\n<p>1.\n&nbsp;Conduct quasi-judicial hearings to\ndetermine if inmates are suitable for parole using California Code of\nRegulations Title 15 (CCR Title 15), Penal Code and Case Law as required. <\/p>\n\n\n\n<p>2.\n&nbsp;Establish appropriate prison terms to\ncalculate the approximate length of prison terms using regulatory matrix and\napplicable case law as required. <\/p>\n\n\n\n<p>3.\n&nbsp;Conduct fact-finding investigations for\ndecision review purposes to ensure all relevant information is considered\nutilizing CCR Title 15, Penal Code, departmental policies and practices,\nOffender\u2019s Central File as required. <\/p>\n\n\n\n<p>4.\n&nbsp;Conduct settlement and pre-hearing\nrequests to negotiate and agree upon dispositions using CCR Title 15, Penal\nCode, departmental policies and practices, etc. for parole revocation terms as\nneeded. <\/p>\n\n\n\n<p>5.\n&nbsp;Rule on prehearing motions including\npostponements, waivers and stipulations for inmates and parolees due to\ncircumstances that preclude the hearing from being conducted using CCR Title\n15, Penal Code and departmental policies and practices as required.<\/p>\n\n\n\n<p>6.\n&nbsp;Review petitions from inmates to\ndetermine if their next parole suitability hearing can be advanced utilizing\nCCR Title 15, Penal Code and departmental policies and practices as required.<\/p>\n\n\n\n<p>7.\n&nbsp;Advance parole dates for inmates found\nsuitable for parole based upon positive behavior in prison utilizing CCR 15 and\ndepartmental policies and practices as required. <\/p>\n\n\n\n<p>8.\n&nbsp;Rescind parole dates for inmates found\nsuitable for parole based upon negative behavior in prison or given an\nimprovident grant utilizing CCR 15, departmental policies and practices and\nCase Law as required. <\/p>\n\n\n\n<p>9.\n&nbsp;Sit on special panel hearing cases\nrecommended for further action by the Division of Adult Parole Operations to\ndetermine if discharge off parole is appropriate utilizing CCR Title 15 and\ndepartmental policies and practices as needed. <\/p>\n\n\n\n<p>10.\n&nbsp;Review administrative procedures and\nregulations used within the Board of Parole Hearings (BPH) to ensure compliance\nwith departmental policies utilizing CCR Title 15 and Case Law as directed. <\/p>\n\n\n\n<p>11.\n&nbsp;Recommend changes to administrative\nprocedures and regulations used within BPH ensure compliance with departmental\npolicies utilizing CCR Title 15 and Case Law as directed. <\/p>\n\n\n\n<p>12.\n&nbsp;Identify and reports on problems or\nsituations relating to policies or procedures of the Department as they relate\nto BPH to ensure protocols, policies, and laws are adhered to as needed. <\/p>\n\n\n\n<p>13.\n&nbsp;Conduct youth offender parole\nsuitability hearings to determine if youth offenders are suitable for parole\nusing CCR Title 15, Penal Code, and Case Law as required. <\/p>\n\n\n\n<p>14.\n&nbsp;Conduct medical parole hearings for\ninmates with serious medical conditions to determine if placement in the\ncommunity is appropriate utilizing Case Law and departmental policies and\npractices as required. <\/p>\n\n\n\n<p>15.\n&nbsp;Determine whether parolees should be\ndischarged from their parole term utilizing CCR Title 15, Penal Code, Case Law\nand departmental policies and practices as required. <\/p>\n\n\n\n<p>16.\n&nbsp;Conduct proceedings for mentally\ndisordered offenders and sexually violent predators to determine if they meet\nthe appropriate criteria for mental health treatment after release from prison\nutilizing CCR Title 15, Penal Code, Case Law, Welfare and Institutions Code,\ndepartmental policies and practices as required. <\/p>\n\n\n\n<p>17.\n&nbsp;Review and schedules cases for hearings\nfor parolees pending revocation utilizing CCR Title 15, Penal Code, Case Law\nand departmental policies and practices as needed. <\/p>\n\n\n\n<p>18.\n&nbsp;Review inmate and parolee appeals\nregarding BPHs\u2019 decisions and CDCR\u2019s decisions on good time credits and the\nlength and conditions of parole utilizing CCR Title 15, Penal Code and\ndepartmental policies and practices as required. <\/p>\n\n\n\n<p>19.\n&nbsp;Administer various proceedings (e.g.\noaths, explains rights, rules on objections) to ensure due process rights are\nmet utilizing CCR Title 15, Penal Code, Case Law and Departmental policies and\npractices as required. <\/p>\n\n\n\n<p>20.\n&nbsp;Obtain lay and expert testimony at\nhearings to ensure due process rights are met utilizing CCR Title 15, Penal\nCode, Case Law and Departmental policies and practices as required. <\/p>\n\n\n\n<p>21.\n&nbsp;Determine appropriate decisions and\nsanctions to be imposed based on evidence provided to ensure due process and\npublic safety are met utilizing CCR Title 15, Penal Code and departmental\npolicies and practices as required. <\/p>\n\n\n\n<p>22.\n&nbsp;Review the length and\/or appropriateness\nof prison sentences imposed by the courts for identified inmates for possible\nrelease utilizing departmental policies and practices and Case Law as required.\n<\/p>\n\n\n\n<p>23.\n&nbsp;Conduct post-hearing interviews in\nvarious cases to share information with stake holders utilizing CCR Title 15,\nPenal Code and departmental policies and practices as required. <\/p>\n\n\n\n<p>24.\n&nbsp;Represent BPH in case planning to assign\nand schedule workload for various administrative reviews utilizing Parole Violation\nDisposition Tracking System, Board Information Technology System, etc. as\nrequired. <\/p>\n\n\n\n<p>25.\n&nbsp;Guide the institution classification\nstaff screening of cases for hearing by BPH to ensure jurisdiction is\nappropriate utilizing CCR Title 15, Penal Code and departmental policies and\npractices as required. <\/p>\n\n\n\n<p>26.\n&nbsp;Participate in policy sessions to\ndetermine how changes in the law should be implemented utilizing subject matter\nexpertise as required. <\/p>\n\n\n\n<p>27.\n&nbsp;Represents the BPH in staff,\nadministrative and professional conferences to inform community interests\ngroups utilizing subject matter expertise when needed. <\/p>\n\n\n\n<p>28.\n&nbsp;Conduct special studies and create\nreports to have information readily available using subject matter expertise\nunder management\u2019s directives as needed. <\/p>\n\n\n\n<p>29.\n&nbsp;Perform legal research and analysis on\nvarious subjects to ensure current practices and procedures are in compliance\nwith the law utilizing CCR Title 15, Penal Code, Case Law and departmental\npolicies and practices as required. <\/p>\n\n\n\n<p>30.\n&nbsp;Give legal advice to Board of Parole\nHearings Legal Department after reviewing case files and consider all\napplicable rules and laws to ensure BPH is in compliance with State and Federal\nguidelines utilizing CCR Title 15, Penal Code, Case Law and departmental policies\nand practices as knowledge of laws and\ncourt decisions pertaining to the functions of the BPH and the CDCR as it\nrelates to criminal proceedings in order to make informed decisions.
