Senate Bill (SB) 483<\/a> went into effect on January 1, 2022. SB 483 was codified under Penal Code (PC) Sections 1171 and 1171.1.<\/p>\n\n\n\n

The law required the California Department of Corrections and Rehabilitation (CDCR) to provide sentencing courts with information regarding incarcerated persons whose sentences include enhancements under Health and Safety Code (HSC) Section 11370.2 or PC Section 667.5(b).<\/p>\n\n\n\n

The information has been provided to the courts in two phases:<\/p>\n\n\n\n

Phase 1<\/strong><\/h2>\n\n\n\n

CDCR sent information to sentencing courts in spring 2022 about individuals who met the bill\u2019s sentencing criteria and have served their base term and any non-qualifying enhancements and are currently serving a sentence based on a qualifying enhancement.<\/p>\n\n\n\n

Phase 2<\/strong><\/h2>\n\n\n\n

All other potentially eligible individuals appeared on lists provided to sentencing courts in summer 2022.<\/p>\n\n\n\n

Method of Delivery<\/strong><\/h3>\n\n\n\n

Lists of prospective individuals were provided to each California superior court via their Executive Court Officer using CDCR’s Secure File Transfer Portal. The lists were also provided to the Judicial Council, the California Public Defenders Association (CPDA) and the California District Attorneys Association (CDAA)<\/p>\n\n\n\n

Review Process<\/strong><\/strong><\/h3>\n\n\n\n

The sentencing courts had the responsibility to complete a review of the judgment, verify the enhancement, and consider resentencing the person. For those persons who have served their base term and any other enhancement and are currently serving a sentence based on the enhancement, the sentencing court had until October 1, 2022, to resentence the person. For all other persons convicted of either enhancement, the court had until December 31, 2023, to resentence the person.<\/p>\n\n\n\n

Resentencing<\/strong><\/h3>\n\n\n\n

After an individual is resentenced, CDCR needs a copy of the amended abstract of judgment and\/or minute order to process the new sentence:<\/p>\n\n\n\n
