{"id":341,"date":"2023-09-26T11:25:06","date_gmt":"2023-09-26T18:25:06","guid":{"rendered":"https:\/\/www.cdcr.ca.gov\/hcdom\/?post_type=dom&#038;p=341"},"modified":"2023-10-30T15:01:39","modified_gmt":"2023-10-30T22:01:39","slug":"5-2-10-merit-issue-complaints","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/hcdom\/dom\/chapter-5-administrative\/article-2-human-resources\/5-2-10-merit-issue-complaints\/","title":{"rendered":"5.2.10 Merit Issue Complaints"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Policy<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block is-style-no-marker\">\n\t\t\t\t\t<p>Appointments and promotions shall be made on the basis of merit and fitness within state civil service.\u00a0 California Correctional Health Care Services (CCHCS) shall comply with California laws and rules governing civil service appointments.\u00a0 All Merit Issue Complaints filed with CCHCS shall be immediately reviewed, investigated, and resolved at the lowest possible level.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Purpose<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block is-style-no-marker\">\n\t\t\t\t\t<p>To describe the process for filing and responding to Merit Issue Complaints within CCHCS.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Procedure<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Types of Merit Issue Complaints<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block is-style-no-marker\">\n\t\t\t\t\t<p>Merit Issue Complaints may be filed for reasons including, but not limited to, the following:<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Interference with promotional opportunities.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Disputes regarding the effective dates of appointments or promotions.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Applicability of alternate salary ranges.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Denial of Merit Salary Adjustments<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Interference with a person\u2019s access to any State Personnel Board appeals process<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The designation of managerial positions pursuant to California Government Code Chapter 10.3. State Employer-Employee Relations, Section 3513.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An employee who believes they have been discriminated against within the state civil service because of political affiliation or opinion.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Filing a Merit Issue Complaint<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CCHCS employees shall file their Merit Issue Complaint in writing with the respective personnel office (either regional or within headquarters [HQ], Human Resources [HR]) within three years of the alleged violation of State Personnel Board\u2019s (SPB) regulation or policy in the hiring and selection process. \u00a0The personnel office shall be contacted regarding the time for filing a Merit Issue Complaint and the department\u2019s levels of review.\u00a0 No particular form is required; however, the <a href=\"https:\/\/www.spb.ca.gov\/content\/appeals\/SPB101_APPEALS_FORM.pdf\">SPB Appeals\/Complaint Form<\/a> may be used.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The employee filing the complaint shall provide enough factual information, detail and any substantiating documentation for CCHCS to ascertain the nature of the complaint.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>All Merit Issue Complaints shall be submitted to the attention of the Deputy Director (DD), HR.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Responding to a Merit Issue Complaint<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block is-style-no-marker\">\n\t\t\t\t\t<p>CCHCS HR shall respond within 90 calendar days of the date of receipt of the Merit Issue Complaint. The personnel office shall inform employees or applicants, by certified or regular mail and by email (with read receipt), at the time the complaint is received, of their right to challenge the department\u2019s denial of the complaint or failure to respond by filing a complaint with the SPB Appeals Division and the timeframe for filing.
