{"id":10134,"date":"2020-03-31T16:06:58","date_gmt":"2020-03-31T23:06:58","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-5-adult-custody-and-security-operations\/article-23-inmate-discipline\/52080-9-hearing-procedures-and-time-limitations\/"},"modified":"2024-08-13T16:41:57","modified_gmt":"2024-08-13T16:41:57","slug":"52080-9-hearing-procedures-and-time-limitations","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-5-adult-custody-and-security-operations\/article-23-inmate-discipline\/52080-9-hearing-procedures-and-time-limitations\/","title":{"rendered":"52080.9 Conduct Reportable to the Board of Parole Hearings"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Rules of the Board of Parole Hearings (BPH) require that specific acts of an incarcerated person\u2019s conduct be reported to the BPH when the incarcerated person has an established or anticipated release date.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>At the discretion of the BPH, a rescission hearing may be held in conjunction with a disciplinary hearing for conduct that is also reportable to the BPH.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>BPH staff may sit in the fact finding and disposition phase of a disciplinary hearing held in conjunction with a rescission hearing by the BPH, however, they shall not act as fact finders or decision makers in the Department\u2019s disposition of disciplinary charges against an incarcerated person.
