{"id":10630,"date":"2020-03-31T16:07:17","date_gmt":"2020-03-31T23:07:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-5-adult-custody-and-security-operations\/article-44-prison-rape-elimination-policy\/54040-12-1-investigation-of-sexual-violence-or-staff-sexual-misconduct-less-than-72-hours-post-incident\/"},"modified":"2021-12-09T23:09:45","modified_gmt":"2021-12-09T23:09:45","slug":"54040-12-1-investigation-of-sexual-violence-or-staff-sexual-misconduct-less-than-72-hours-post-incident","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-5-adult-custody-and-security-operations\/article-44-prison-rape-elimination-policy\/54040-12-1-investigation-of-sexual-violence-or-staff-sexual-misconduct-less-than-72-hours-post-incident\/","title":{"rendered":"54040.12.1 Investigation of Sexual Violence or Staff Sexual Misconduct \u2013 less than 72 hours post incident"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If the alleged incident is reported or discovered less than 72 hours after the occurrence, in addition to the provisions discussed in DOM Section 54040.8, the custody supervisor shall secure the alleged crime scene (if feasible) and secure the alleged inmate suspect (if he\/she can be identified) for potential forensic processing.\u00a0 The custody supervisor shall determine the need to transport the inmate for a forensic exam as follows:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Sexual Harassment Incidents:\u00a0 The victim\/suspect will not be transported for a forensic exam.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Abusive Sexual Contact Incidents:\u00a0 The SART\/SANE shall be consulted to make a determination as to whether the inmate victim\/inmate suspect should be taken for a forensic examination.\u00a0 The inmate victim may refuse the forensic examination and the refusal should be video recorded.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Nonconsensual Sex Acts:\u00a0 The inmate victim\/inmate suspect shall be transported for a forensic examination.
