{"id":10635,"date":"2020-03-31T16:07:17","date_gmt":"2020-03-31T23:07:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-5-adult-custody-and-security-operations\/article-44-prison-rape-elimination-policy\/54040-13-allegation-follow-up\/"},"modified":"2021-12-09T23:14:02","modified_gmt":"2021-12-09T23:14:02","slug":"54040-13-allegation-follow-up","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-5-adult-custody-and-security-operations\/article-44-prison-rape-elimination-policy\/54040-13-allegation-follow-up\/","title":{"rendered":"54040.13 Allegation Follow&#8209;up"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For at least 90 days following a report of sexual violence or staff sexual misconduct, the institutional PCM shall monitor the conduct and treatment of inmates or employees who reported the sexual violence or staff sexual misconduct and of the victim to ensure there are no changes that may suggest retaliation.\u00a0 The PCM may delegate these monitoring functions to staff assigned to the Investigative Services Unit or to a supervisory staff member and has the discretion to assign this monitoring in other circumstances:\u00a0 If the reported conduct is sexual harassment, when a volunteer or independent contractor made the report of sexual violence, staff sexual misconduct, or sexual harassment, or if any person fears retaliation for cooperating with an investigation.\u00a0 The assigned supervisor shall notify the institutional PCM of any such changes.\u00a0 The PCM shall act promptly (in accordance with DOM Article 14, Section 31140.22) to remedy any such retaliation and ensure a CDCR Form 2304 or 2305, Protection Against Retaliation, is initiated.\u00a0 Items to be monitored on the CDCR Form 2304 or 2305 include periodic inmate status checks, inmate disciplinary reports, housing or program changes, or negative performance reviews or reassignments of staff.\u00a0 The monitoring shall continue beyond 90 days if the initial monitoring indicates a continuing need.\u00a0 The PCM shall ensure all Protection Against Retaliation forms are maintained as required in the Records Retention Schedule.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The obligation to monitor shall terminate if the investigation determines that the allegation is unfounded or proven false.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>When the inmate is transferred to another institution within the 90-day monitoring period, the CDCR Form 2304 shall be forwarded to the receiving institution.\u00a0 The PCM\/designee at the sending institution shall make contact with the PCM\/designee at the receiving institution to provide an overview of the case, noting the remaining monitoring timeframes.\u00a0 Upon completion of the monitoring period, the PCM\/designee at the receiving institution shall return the completed CDCR Form 2304 to the PCM\/designee at the sending institution for retention in the file and audit purposes.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t","protected":false},"parent":10608,"template":"","class_list":["post-10635","dom","type-dom","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
