{"id":10859,"date":"2020-03-31T16:07:26","date_gmt":"2020-03-31T23:07:26","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-5-adult-custody-and-security-operations\/article-53-inmate-parolee-appeals\/54100-25-1-rights-and-responsibilities-statement\/"},"modified":"2025-12-29T18:23:38","modified_gmt":"2025-12-29T18:23:38","slug":"54100-25-1-rights-and-responsibilities-statement","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-5-adult-custody-and-security-operations\/article-53-inmate-parolee-appeals\/54100-25-1-rights-and-responsibilities-statement\/","title":{"rendered":"54100.25.1 Rights and Responsibilities Statement"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An appeal that alleges misconduct by a departmental peace officer as defined in 15 CCR \u00a73291(b) shall be accompanied by the 15 CCR \u00a73391(b) Rights and Responsibility Statement.<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An appeal received without such statement shall be processed and the statement obtained from the appellant at the time of the initial appeal interview.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Should the inmate\/parolee refuse to sign the Rights and Responsibilities Statement, the appeal shall be cancelled for lack of cooperation.<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Cancellation does not relieve the Department of its responsibility to address alleged staff misconduct as revealed or suggested via the cancelled appeal.
