{"id":11783,"date":"2020-03-31T16:08:22","date_gmt":"2020-03-31T23:08:22","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-7-adult-case-records-information\/article-12-time-computations\/73030-15-retention-in-custody-past-scheduled-release-date\/"},"modified":"2020-03-31T16:08:22","modified_gmt":"2020-03-31T23:08:22","slug":"73030-15-retention-in-custody-past-scheduled-release-date","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-7-adult-case-records-information\/article-12-time-computations\/73030-15-retention-in-custody-past-scheduled-release-date\/","title":{"rendered":"73030.15 Retention in Custody Past Scheduled Release Date"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CCR 3323 provides that in some instances a person may be retained in custody beyond their scheduled release date because of a serious disciplinary infraction for which credit may be lost though the CDC Form 115 may ultimately be dismissed or reduced to an administrative infraction.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>It is necessary that the C-File reflect the reason the person was retained in custody.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The following procedures are authorized by CCR 3323 and should be used to properly record this information:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>On the scheduled release date, prepare a CDC Form 128-B chrono indicating &#8220;Subject being retained in custody pending disposition of CDC Form 115 Log #______ for which ______ days may be lost.&#8221;<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Post entry on CDC Form 112, &#8220;Retained in custody pending disposition of CDC Form 115 Log #______.&#8221;<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If the CDC Form 115 is dismissed, prepare another CDC Form 128-B indicating &#8220;CDC Form 115 of ( date ) dismissed. Subject released on parole.&#8221;<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Post entry on CDC Form 112, &#8220;Disciplinary dismissed. Released on parole.
