{"id":12703,"date":"2020-03-31T16:10:28","date_gmt":"2020-03-31T23:10:28","guid":{"rendered":""},"modified":"2020-03-31T16:10:28","modified_gmt":"2020-03-31T23:10:28","slug":"84010-2-1-special-procedures-for-petitions-for-revocation-or-the-imposition-of-remedial-sanctions-when-a-parolee-is-arrested-in-a-county-other-than-the-county-of-residence-supervision","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-8-adult-parole-operations\/article-26-parole-violations-and-revocations\/84010-2-1-special-procedures-for-petitions-for-revocation-or-the-imposition-of-remedial-sanctions-when-a-parolee-is-arrested-in-a-county-other-than-the-county-of-residence-supervision\/","title":{"rendered":"84010.2.1 Special Procedures for Petitions for Revocation or the Imposition of Remedial Sanctions When a Parolee is Arrested in a County Other Than the County of Residence\/Supervision"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Parole Agent<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If a case is not already entered in PVDTS, initiate the case in PVDTS.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Enter the charges in PVDTS and complete the CDCR Form 1502-B, Probable Cause Determination.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If local charges are pending in the county of arrest:<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complete the CDCR Form 1500, Parole Violation Decision Making Instrument (PVDMI) to defer the charges to the local jurisdiction and submit the form to the unit supervisor.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If the parolee had an active absconding warrant, complete the Judicial Council of California (JCC) Form CR-302, Request and Order to Recall Warrant and submit the form to the unit supervisor for recall of the warrant.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Monitor the case while the parolee is in local custody.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Obtain the Minute Order or other judicial document if the court finds that a parole and\/or law violation occurred.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>In the PVDTS &#8220;Custody History&#8221; tab, remove the PC 3056 hold and provide reporting instructions.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If local charges are not pending, the parolee is being held on a PC 3056 hold only and will be transported back to the county of residence\/supervision in custody:<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The transportation must be completed prior to the &#8220;AOR Due Date&#8221; in PVDTS.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Contact the holding facility and arrange to pick up the parolee.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Upon arrival at the holding facility, contact the Warrant Unit to release the hold with instructions for the parolee to be released to the custody of the parole agent.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Transport and book the parolee into the appropriate facility in the county of residence\/supervision.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Update custody location and booking number information in PVDTS.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complete the violation disposition process, i.e., imposition of remedial sanctions or petition for revocation.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Unit Supervisor<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If the parolee will be released from the county jail with reporting instructions, idle the case in PVDTS and select &#8220;out of county with reporting instructions&#8221; from the dropdown menu. When the parolee reports to the parole unit, reactivate the case in PVDTS and initiate the disposition process.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If the parolee remains in custody:<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Ensure transportation to the jail in the county with jurisdiction to hear the petition for revocation.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Ensure that the transportation is completed prior to the &#8220;AOR Due Date&#8221;
