{"id":31844,"date":"2024-05-09T22:13:53","date_gmt":"2024-05-09T22:13:53","guid":{"rendered":"https:\/\/www.cdcr.ca.gov\/operations-manual\/?post_type=dom&#038;p=31844"},"modified":"2024-05-16T23:57:45","modified_gmt":"2024-05-16T23:57:45","slug":"33070-2-purposes","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-3-personnel-training-and-employee-relations\/article-26-staff-misconduct-allegations-involving-an-inmate-or-parolee\/33070-2-purposes\/","title":{"rendered":"33070.3  Definitions"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Allegations Against Staff Tracking System (AASTS) \u2013 An electronic data system used to log and track allegations of staff misconduct involving department staff.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Allegation Decision Index (ADI) \u2013 The list of criteria used by CST to determine whether an allegation of staff misconduct should be referred to the AIU for investigation, or to the Hiring Authority for an allegation inquiry.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Allegation Inquiry \u2013 The gathering of relevant facts and evidence by a Locally Designated Investigator (LDI) for a complaint that contains an allegation of staff misconduct.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Allegation Inquiry Report \u2013 The confidential report prepared by an LDI following an allegation inquiry.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Allegation Investigation Unit (AIU) \u2013 The unit within the OIA that conducts investigations into complaints alleging misconduct toward inmates and parolees as set forth in Title 15,\u00a0 section 3486.2, and reviews Allegation Inquiry Reports completed by LDIs.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>AIU Investigator \u2013 An investigator within AIU assigned to conduct a confidential investigation.<br>Appointing Power &#8211; The Secretary of the department.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Appointing Power &#8211; The Secretary of the department.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Case Tracking System (CTS) \u2013 An electronic system that allows real time documentation of investigative case activity and allows various participants within the employee disciplinary process to access documents, monitor cases, and record key decisions and due dates.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Central Repository \u2013 A secure collection location for submission of staff misconduct allegations documented or received by department staff. A Central Repository may be a physical location at a work site, or via an email address provided for the purpose of submitting allegations of staff misconduct.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Centralized Screening Team (CST) \u2013 The entity within OIA that reviews complaints to determine if the documentation contains a routine issue, alleges staff misconduct toward an inmate or parolee, or alleges staff misconduct not toward an inmate or parolee.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Clarification Interview \u2013 An interview conducted by CST staff when clarification is required to make a screening decision.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complaint \u2013 Any documentation or verbal statement received by the department, from any source, that contains a routine issue or alleges staff misconduct.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complainant \u2013 A person making a complaint against departmental staff.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Deputy Director, Office of Internal Affairs (OIA) \u2013 An individual responsible for the operation and functions of the OIA.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Department Staff \u2013 California Department of Corrections and Rehabilitation (CDCR) employees, contractors, and volunteers.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Designated Case \u2013 A case assigned to an EAPT VA.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Employment Advocacy and Prosecution Team (EAPT) \u2013 The entity in the OLA responsible for providing legal counsel and representation to the department during the employee investigation, discipline, and appeal processes.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Hiring Authority \u2013 Has the same meaning in this Article as in Title 15, section 3392(a)(11).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Investigation &#8211; The gathering of facts and evidence by an OIA Investigator.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Investigation Assignment Index (IAI) \u2013 The index used by an AIU manager to make a decision regarding the level of AIU investigator to be assigned to conduct an investigation.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Investigation Assignment Decision \u2013 The decision made by the AIU manager of the level of AIU investigator to be assigned to conduct an investigation.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Investigation Report \u2013 The confidential report prepared by an OIA investigator following an investigation.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Locally Designated Investigator \u2013 Department staff trained by OIA to collect evidence, conduct allegation inquiries, and draft Allegation Inquiry Reports.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Monitored Cases \u2013 A case monitored by the Office of the Inspector General (OIG).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Office of Grievances (OOG) \u2013 The entity within CDCR with the authority to log and track grievances filed by an inmate or parolee.
