{"id":36010,"date":"2026-07-21T18:29:12","date_gmt":"2026-07-21T18:29:12","guid":{"rendered":"https:\/\/www.cdcr.ca.gov\/operations-manual\/?post_type=dom&#038;p=36010"},"modified":"2026-07-27T21:28:32","modified_gmt":"2026-07-27T21:28:32","slug":"52050-13-1-arrest-of-private-citizens-with-minor-children-in-their-custody","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-5-adult-custody-and-security-operations\/article-19-arrest-search-and-seizure\/52050-13-1-arrest-of-private-citizens-with-minor-children-in-their-custody\/","title":{"rendered":"52050.13.1 Arrest of Private Citizen(s) with Minor Child(ren) in their Custody"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>When a CDCR peace officer arrests a private citizen accompanied by a minor(s), the following steps shall be taken to ensure the safety and well-being of the minor(s):<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Reasonable attempts shall be made to contact the Child Protective Services (CPS) on-call social worker, to consult on the circumstances of the minor(s) and the facts surrounding the arrest.<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>If it is determined the minor(s) will be taken into temporary custody, the peace officer shall ensure that the child is delivered to CPS in accordance with this policy.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The CDCR peace officer shall take reasonable steps to facilitate the release of the minor(s) to another parent, relative, or guardian, unless it reasonably appears that the release would endanger the minor(s). The CDCR peace officer shall:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Provide the parent, relative or guardian identification information to CPS to check for previous allegations of abuse.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Review the California Law Enforcement Telecommunications System (CLETS) to verify the parent, relative or guardian has no prior convictions of crimes against minors and there are no active wants or warrants.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Verify the identity of either the parent, relative, guardian, or CPS representative, prior to releasing custody of the minor(s).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complete the CDCR Form 107, Release of Minor(s).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Obtain signatures from the parent or guardian releasing the minor(s) and the person receiving custody of the minor(s).
