{"id":7378,"date":"2020-03-31T09:23:17","date_gmt":"2020-03-31T16:23:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-4-types-of-litigation\/"},"modified":"2020-03-31T09:23:17","modified_gmt":"2020-03-31T16:23:17","slug":"14010-4-types-of-litigation","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-4-types-of-litigation\/","title":{"rendered":"14010.4 Types of Litigation"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Litigation may involve criminal charges against a party or it may be seeking to correct some civil wrong.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Generally, the Department and\/or its employees become involved in judicial proceedings for one or more of the following reasons:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An inmate is participating in litigation, which may or may not name the Department as a party. This may involve:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An active case in which the inmate is a party.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An active case in which the inmate is needed as a witness.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>A recently filed case in which the inmate must be served as a party.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The Department and\/or its employees have been named as parties in a case arising from departmental activities.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An employee has been named as a party in a case, which arises from the employee&#8217;s duties with the Department.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>A party to a case requires some information in the possession of the Department or its employees, such as:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The testimony of an employee who observed an event (a percipient witness).<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The testimony of an employee who has some expertise in a particular field but no direct knowledge of the event which is the subject of the case (an expert witness).<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>A record in possession of the Department or an employee.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Anytime the Department becomes involved in legal proceedings, the AG&#8217;s Office acts as the attorney for the Department and\/or its employees and represents the Department and its employees in court except when:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The AG&#8217;s Office authorizes the Department to hire outside counsel.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The AG&#8217;s Office asks a DA to represent the Department in a particular matter.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The action is filed in small claims court as discussed in the DOM 14010.8.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<\/ul>\n\t","protected":false},"parent":7374,"template":"","class_list":["post-7378","dom","type-dom","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
