{"id":7391,"date":"2020-03-31T09:23:17","date_gmt":"2020-03-31T16:23:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-6-9-subpoenas-instructions-to-subpoenaed-employees\/"},"modified":"2020-03-31T09:23:17","modified_gmt":"2020-03-31T16:23:17","slug":"14010-6-9-subpoenas-instructions-to-subpoenaed-employees","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-6-9-subpoenas-instructions-to-subpoenaed-employees\/","title":{"rendered":"14010.6.9 Subpoenas &#8211; Instructions to Subpoenaed Employees"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The OLA shall immediately be notified when:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An authorized employee receives a subpoena for the Secretary, Undersecretary, Chief Deputy Secretary, Assistant Secretary, or Director.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>There is a need to quash a subpoena.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The affected employee or the litigation coordinator believes the subpoena was not properly served.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The OLA shall provide directions on how to proceed.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Local litigation coordinators, CCRM&#8217;s, or a CCRA shall immediately contact the AG&#8217;s Office if the subpoena is connected to a case in which the AG&#8217;s Office is representing the State, the Department, or an employee.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The procedure for referrals to the AG&#8217;s Office is covered under DOM 14010.6.11.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Within one week of sending the transmittal letter to the AG&#8217;s Office, case records personnel shall ensure that the employee, on whose behalf service had been accepted, has signed and forwarded to the AG&#8217;s Office a Request for Representation.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>When an employee receives a subpoena (other than as outlined above), there is no need to notify the OLA, unless there are reasons to attempt to quash the subpoena.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Anytime an employee is served with, or otherwise receives, a subpoena arising from employment with the Department, the employee shall:<\/p>\n\t\t\t\t\t<ul class=\"cdcr-dom-group-block\">\n\t\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Contact the litigation coordinator, the CCRM or CCRA.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Complete a Request for Representation, unless a request has previously been filed for the specific case.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Employees consulting or testifying as a specialist or an expert witness, based on experience gained in the course of their employment with the Department, should first review Department regulations governing incompatible activities, CCR Section 3413(a)(10).<\/p>\n\t\t\t\t\t<\/li>\n\t\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Retired employees shall contact the appropriate staff person at their former institution, region, office, or the OLA.<\/p>\n\t\t\t\t\t<\/li>\n\t\t<\/ul>\n\t","protected":false},"parent":7374,"template":"","class_list":["post-7391","dom","type-dom","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
