{"id":7393,"date":"2020-03-31T09:23:17","date_gmt":"2020-03-31T16:23:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-6-10-1-subpoenas-non-peace-officer-personnel-records\/"},"modified":"2026-05-15T22:20:06","modified_gmt":"2026-05-15T22:20:06","slug":"14010-6-10-1-subpoenas-non-peace-officer-personnel-records","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-1-general-administration\/article-18-legal-matters\/14010-6-10-1-subpoenas-non-peace-officer-personnel-records\/","title":{"rendered":"14010.6.10.1 Subpoenas &#8211; Non&#8209;Peace Officer Personnel Records"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Response to a subpoena for information from non-peace officer personnel records shall be as follows:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Provide the information if:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Employee consents in writing to the disclosure of the information; or<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Disclosure is permissible as a public record or as non-exempt personal information (see DOM 13030 and 13040).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Contact the OLA if:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Employee does not consent in writing to the disclosure of the information; and<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Exempt personnel information is requested.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>In civil actions in which the department is not involved, and where only payroll or medical records are requested, a subpoena for non-peace officer records shall be complied with. No appearance shall be made on behalf of the department to oppose a motion for non-peace officer records.
