{"id":8017,"date":"2020-03-31T09:24:17","date_gmt":"2020-03-31T16:24:17","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-3-personnel-training-and-employee-relations\/article-1-equal-employment-opportunity\/31010-9-4-external-complaint\/"},"modified":"2024-01-14T00:14:47","modified_gmt":"2024-01-14T00:14:47","slug":"31010-9-4-external-complaint","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-3-personnel-training-and-employee-relations\/article-1-equal-employment-opportunity\/31010-9-4-external-complaint\/","title":{"rendered":"31010.9.4 External Complaint"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>All persons covered by this policy may elect to file a discrimination complaint with the following external compliance agencies:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The California Civil Rights Department (CRD) \u2013 A complainant may file with CRD within three (3) years from the date the discrimination occurred.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>United States (U.S.) Equal Employment Opportunity Commission (EEOC) \u2013 A complainant may file a discrimination complaint with EEOC within 300 days from the date the discrimination occurred.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>U.S. Department of Labor \u2013 A complaint filed with the U.S. Department of Labor should be filed within a reasonable time of when the employee discovers that their Family and Medical Leave Act (FMLA) rights have been violated. In no event may a complaint be filed more than two years after the action which is alleged to be a violation of FMLA occurred, or three years in the case of a willful violation.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>When a charge of discrimination is received from external compliance agencies, OCR shall review the charge to determine the appropriate course of action and take suitable corrective action where appropriate.
