{"id":8270,"date":"2020-03-31T09:24:26","date_gmt":"2020-03-31T16:24:26","guid":{"rendered":"http:\/\/cdcr.test\/dom\/chapter-3-personnel-training-and-employee-relations\/article-6-appointments\/31060-6-3-3-out-of-class-assignments\/"},"modified":"2026-06-26T17:23:12","modified_gmt":"2026-06-26T17:23:12","slug":"31060-6-3-3-out-of-class-assignments","status":"publish","type":"dom","link":"https:\/\/www.cdcr.ca.gov\/operations-manual\/dom\/chapter-3-personnel-training-and-employee-relations\/article-6-appointments\/31060-6-3-3-out-of-class-assignments\/","title":{"rendered":"31060.6.3.3 Out&#8209;of&#8209;Class Assignments"},"content":{"rendered":"\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Policy<\/strong><br><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An Out-of-Class (OOC) assignment is a short-term full-time assignment of an employee to perform duties outside the scope of their current classification. The purpose of an OOC assignment is to meet limited duration, temporary staffing needs to mitigate the loss of safety, property, or critical operations, when all other options have been exhausted.<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignments can only be assigned to meet one of the following specific operational needs:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Risk to health and safety.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The interruption of public service.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An economic loss or program delay.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Inadequate management or supervision of a unit or function which cannot be offset by temporarily restructuring reporting relationships.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For represented employees, the California Department of Corrections &amp; Rehabilitation (CDCR) and the California Correctional Health Care Services (CCHCS) shall follow the provisions of the applicable Bargaining Unit Memorandum of Understanding (MOU).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For excluded employees, CDCR and CCHCS shall follow the California Code of Regulations (CCR), Title 2, Division 1, Chapter 3, Subchapter 1, Article 16, section 599.810, Out-of-Class Assignments \u2013 Excluded Employees.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For unassigned classifications, which can be designated rank and file or supervisory, when CDCR and CCHCS have designated a position based on standardized staffing, represented employees shall follow the provisions of the applicable MOU, and supervisory employees shall follow CCR Title 2, section 599.810.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An employee working in an OOC assignment shall be assigned full-time to the OOC assignment. They shall not work a split schedule between their appointed position and the OOC assignment. This includes not working overtime in the employee\u2019s appointed position.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>To ensure all eligible employees are provided OOC opportunities, assignments shall be made according to the selection process outlined in section 31060.6.3.3(b).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>A CDCR 1821 Out-of-Class Checklist\/Approval form must be completed for all OOC assignments and extensions and serves as documentation for audits, payment of claims, and examination eligibility.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>All civil service alternatives must be explored before utilizing an OOC assignment. Vacant positions, including long-term temporary vacancies (over 6 months), must have demonstrated recruitment efforts initiated prior to utilizing an OOC assignment. Additionally, the following alternatives shall be considered before pursuing or extending an OOC assignment:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Permanent Full-Time appointments.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Limited-Term (LT) appointments.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Temporary Authorization appointments.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Training and Development assignments.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Completed Post and Bid opportunity, if required by the vacant position\u2019s MOU.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Workload distribution alternatives must be explored and used in lieu of an OOC assignment when available. These alternatives include:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Temporary reassignments of work to appropriately classified positions.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Delaying or canceling other less critical work.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Modifying duties until the position can be filled.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Redirecting a unit\u2019s staff, workload, or resources.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Emergency appointments on an acting basis in accordance with CCR, Title 2, Division 1, Chapter 1, Subchapter 1.3, Article 12, section 302.3 may be considered in lieu of OOC when appropriate.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignments shall only be made to budgeted positions or funded blanket positions, which are approved by Headquarters (HQ) Human Resources (HR) and the Budget Management Branch (BMB) for CDCR or the Fiscal Management Section (FMS)<br>for CCHCS.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignments for employees in exempt (i.e., Governor\u2019s Office appointee) and executive classifications, (i.e., Career Executive Assignments [CEA], Receiver\u2019s Career Executive Assignments [RCEA], and Chief Deputy Warden [CDW]), shall be processed by the Executive Appointments Unit (EAU), for CDCR, or Executive Recruitment and Selection Unit (ERSU), for CCHCS. For guidance and interpretation in determining OOC assignments for CEA, RCEA, CDW, and exempt classifications, inquiries shall be directed to the EAU for CDCR or the ERSU for CCHCS.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>With the exception of exempt classifications, an employee shall not begin an OOC assignment prior to receiving all required approvals and clearances from the assigned Personnel\/HR Office [See section 31060.6.3.3(d)].<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Movement of the employee into a different vacant position performing the same duties to continue an OOC assignment beyond time limitations specified by MOU or other law is prohibited.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An OOC assignment to a classification other than an employee\u2019s appointed classification, but within the same salary range, may not result in additional compensation. However, the employee is entitled to qualifying work experience for examination purposes.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>In order for an employee to receive credit for the qualifying work experience gained in an OOC assignment towards the minimum qualifications for an examination or appointment, the employee shall attach a copy of the memorandum documenting the completion of the OOC assignment (i.e., OOC completion memorandum) to the application for the examination or position for which they are applying.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An employee working in an OOC assignment assumes the associated work week group, schedule, leave, and overtime requirements of the OOC classification during the OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignments may be ended by the employee or the Hiring Authority (HA) or designee responsible for the OOC assignment at any time for any job-related reason or business need.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>An employee shall not perform OOC in a peace officer position unless all requirements have been met pursuant to CCR Title 11, sections 1950 through 1955, which include but are not limited to, background, training, and psychological evaluation clearances.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Employees on probation in their current classification are not eligible for OOC.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Approval for selection of an employee for an OOC position under a HA different from that of their existing position must be approved by the HA responsible for the OOC assignment. As OOC assignments provide employees with qualifying work experience for purposes of upward mobility, the HA responsible for the employee\u2019s existing position cannot deny the employee the ability to work the OOC assignment. All approvals must be<br>obtained prior to the employee beginning the OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>As part of the acceptance of an OOC assignment, the employee assumes the headquarters (office) of the OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Out-of-Class Selection Process<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC shall be made according to a merit-based selection process. This process shall include:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Notifying employees of available OOC opportunities by posting a solicitation of the OOC opportunity on the CDCR and CCHCS OOC Bulletin Board SharePoint site. An additional method of notification is also required, such as by electronic mail to all local employees (at minimum) or hard copy postings at assigned building areas. Solicitation shall be provided for a minimum of five business days (i.e., Monday \u2013 Friday, excluding holidays) before the due date for response. Multiple OOC opportunities may be combined on one solicitation if the classification, duty statement, location, tenure, time-base, and the HA are the same. If known, the number of OOC positions available should be indicated.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Using a pre-determined selection method such as screening criteria or interview scoring when determining selection between multiple interested and eligible employees. The selection method and criteria must align with the duties and performance expectations of the position.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Ensuring the OOC occurs in accordance with the employee\u2019s current and OOC assignment\u2019s MOU and CCR.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Compliance with any licensure or other special requirement of the OOC position.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Unless otherwise mandated by MOU, an OOC assignment is not required to be re-posted if the following are met:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The assignment is identical to an OOC assignment previously posted as required by section 31060.6.3.3(b)(1)(A).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The assignment is approved in accordance with section 31060.6.3.3(d) within 60 calendar days of the end date of the previous posting.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>The assignment is performing the same duties in the same classification, with the same location, tenure, time-base, and HA responsible for the OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Responsibilities<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For purposes of this section, personnel staff is defined as those individuals working in the institution personnel office, or individuals designated as HQ program designees (for CDCR) and Human Resource Hiring Analyst (HRHA) or ERSU (for CCHCS).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Hiring Managers (or designees) shall:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Comply with subsections 31060.6.3.3(a)(5) through (a)(8) before, or simultaneously with, initiating an OOC assignment request.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>In collaboration with personnel staff, develop a selection method and criteria for all OOC assignment requests utilizing the applicable CDCR or CCHCS Hiring Guide prior to soliciting interest.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Submit a CDCR 1821 Out-of-Class Checklist\/Approval form, and any required documentation to personnel staff.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>HAs (or designees) shall:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Verify funds are available within the current budget prior to approving an OOC assignment request.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Approve or deny the OOC assignment by authorizing the CDCR 1821 Out-of-Class Checklist\/Approval form.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Personnel staff shall:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Obtain OOC assignment pre-approvals as required by local and statewide business process requirements [See section 31060.6.3.3(d)].<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Review OOC assignment to ensure appropriateness of the OOC [See subsections 31060.6.3.3(a)(5) through (a)(8)].<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Post the OOC assignment solicitation to all employees as required by subsection 31060.6.3.3(b)(1)(A).<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Collect and maintain all required OOC documentation.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Review candidate eligibility for OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Finalize the CDCR 1821 Out-of-Class Checklist\/Approval form, OOC assignment duty statement, current and proposed organizational chart, and memorandum to the employee.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Approve or deny OOC assignment requests in accordance with delegation levels as described in subsection (d) below.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Approvals<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>All OOC assignment requests require approval in accordance with delegation levels to ensure all viable alternatives are exhausted prior to the commencement of the OOC assignment.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CalHR has delegated approval authority to CDCR and CCHCS for OOC assignments that are consistent with the requirements and limitations identified in MOUs and CCR, Title 2, section 599.810. There is no exception to request an extension of time for an incumbent in an OOC position beyond these limitations.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>Approval is required for OOC assignments prior to the OOC start date.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignments to exempt positions may begin upon notification from the Governor\u2019s Office to the department.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>OOC assignment requests require approval from the following:<\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CDCR headquarters programs: Employment and Classification Services (ECS) Analyst.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CCHCS programs and institutions: HRHA.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CDCR exempt, CEA, or CDW classifications: EAU.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CCHCS executive positions, RCEA, or CEA: ERSU.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>CDCR institutions: Each institutional personnel office\u2019s delegation is outlined in the delegation agreement completed following the annual review conducted by HQ ECS. Delegation is determined by good management practices, overall accuracy, and meeting established timelines.<\/p>\n\t\t\t\t\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\t<\/ul>\n\t\n\t<\/li>\n\t\n\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p><strong>Record Keeping<\/strong><\/p>\n\t\t\t\t\n\t<ul class=\"cdcr-dom-group-block\">\n\t\t\n\t<li class=\"cdcr-dom-item-block\">\n\t\t\t\t\t<p>For audit purposes, depending upon the location of the OOC assignment, the local personnel office or HQ program designee, for CDCR, and the regional or HQ HR Office, for CCHCS, shall keep a record of all documentation associated with the OOC assignment for a minimum of five years in accordance with the CCR, Title 2, Division 1, Chapter 1, Subchapter 1, Article 2, section 26. This includes a copy of the selection method and criteria, application packages, and the OOC assignment completion notice.
