The California Department of Corrections and Rehabilitation (CDCR) utilizes equipment that has been identified as military equipment defined within Assembly Bill (AB) 481 codified as Government Code sections 7070 through 7075), Funding, Acquisition, and Use of Military Equipment. CDCR has created a list of military equipment which is being utilized currently and prior to January 1, 2022. CDCR will update this list as additional military equipment is funded, acquired and or used within the Department.

The Chief of the Office of Correctional Safety has oversight of the military equipment use policy.

All listed military equipment is governed and authorized by the Department Operations Manual (DOM) Article 2 Use of Force, section 51020; the California Code of Regulations, Title 15, Article 1.5, Use of Force and Restraining Devices, section 3268, Use of Force; and Penal Code sections 196, 832, and 835a.

CDCR ensures compliance with the military equipment use policy as defined within the DOM, Chapter 3, Article 22, and Employee Discipline.

The fiscal impact of the military equipment, including the initial costs of obtaining the equipment and estimated annual costs of maintaining it, will be updated and placed on the CDCR website annually for each piece of equipment.

This policy includes the following information:

  • A description of the military equipment, the quantity sought, the equipment’s capabilities, the equipment’s expected lifespan, and product descriptions from the manufacturer of the equipment.
  • The purposes and authorized uses for which the CDCR proposes to use each type of military equipment.
  • The fiscal impact of each type of military equipment, including the initial costs of obtaining the equipment and, if applicable, the estimated annual costs of maintaining the equipment.
