REQUESTS FOR CERTIFIED PENAL CODE (PC) SECTION 969b PACKETS FOR DISCHARGED PERSONS 

DEFINITION 

PC 969b.   “For the purpose of establishing prima facie evidence of the fact that a person being tried for a crime or public offense under the laws of this State has been convicted of an act punishable by imprisonment in a state prison, county jail or city jail of this State, and has served a term therefor in any penal institution, or has been convicted of an act in any other state, which would be punishable as a crime in this State, and has served a term therefor in any state penitentiary, reformatory, county jail or city jail, or has been convicted of an act declared to be a crime by any act or law of the United States, and has served a term therefor in any penal institution, the records or copies of records of any state penitentiary, reformatory, county jail, city jail, or federal penitentiary in which such person has been imprisoned, when such records or copies thereof have been certified by the official custodian of such records, may be introduced as such evidence.” 

DEPARTMENTAL POLICY 

Current California Department of Corrections and Rehabilitation (CDCR) policy is to send certified PC Section 969b packets to California District Attorneys and the Attorney General’s Office and send certified PC Section 969b packets with an exemplification certificate to federal agencies, Federal Department of Justice, prosecutors and police departments from other states. 

Documents that are included in the PC Section 969b packet include: 

  • Certification letter w/State of CA seal or exemplification certificate 
  • Abstract of Judgment/Minute Order or other appropriate documents 
  • External Movement History 
  • Fingerprint card(s) 
  • Photo 

If your request does not fall within CDCR policy to receive a certified PC Section 969b packet but wish to receive documents out of a discharged person’s central file, one should fax an informal request to the Archives Unit at:

Processing Times 

California PC Section 969b packet requests will require a minimum of 15 business days (excluding holidays) from date of receipt to complete processing.  Out of State requests will require a minimum of 30 business days (excluding holidays) from date of receipt to complete processing. 

REQUESTING THE PC SECTION 969b PACKET 

CDCR is responsible for the California State Prisons and Parole system.  If the PC Section 969b packet you are requesting is for an incarcerated/discharged person who served a county jail, federal or probation commitment, as opposed to a state prison commitment, contact the respective entity where the incarcerated/discharged person was housed in order to obtain the requested information. 

Requests for certified PC Section 969b packets pertaining to discharged persons are processed at the Archives Unit.  A CDCR number is required to process the request.  PC Section 969b packets for incarcerated persons, or   persons on active parole are to be directed to the appropriate institution or parole case records. 

If you do not have a CDCR number(s) or know the location of the person, please visit the California Incarcerated Records & Information Search (CIRIS) – CDCR or contact CDCR’s Identification Unit at (916) 445-6713, Monday through Friday (excluding holidays), 8:00 a.m.  to 4:30 p.m. PST for assistance. 

Please note some CDCR discharged persons will have multiple CDCR numbers.  List only those CDCR number(s) on the request form in which you require a PC Section 969b packet.
