14010.14 Employee’s Right to Obtain Private Counsel

In job related actions any employee has the right to be represented, at their personal expense, by the attorney of the employee’s choice rather than by the AGAttorney General’s Office. Where it is determined that the Department shall provide defense counsel, and the employee does not wish to provide counsel at their own expense, the Department shall have the AGAttorney General’s Office, or private counsel (in cases where the AGAttorney General’s Office has a conflict of interest), represent the employee at Department expense.
