Article 1 – Peace Officer Authority
51010.1 Policy

It is the policy of the California Department of Corrections and Rehabilitation (CDCRCalifornia Department of Corrections and Rehabilitation) to ensure that CDCRCalifornia Department of Corrections and Rehabilitation peace officer authority comports with applicable State statutes, regulation and mutual aid agreements. agreements.
51010.2 Purpose

The purpose of this Article is to clarify CDCRCalifornia Department of Corrections and Rehabilitation peace officer authority as it relates to incarcerated persons, supervised persons, and California law enforcement requests for assistance.
51010.3 Peace Officer Authority

CDCRCalifornia Department of Corrections and Rehabilitation peace officer authority is outlined in Penal Code (PCPenal Code) Sections 830.2(d)(1) & (2) and PCPenal Code 830.5. While normal CDCRCalifornia Department of Corrections and Rehabilitation peace officer authority under PCPenal Code 830.5 generally applies to custody of incarcerated persons either inside or outside of a CDCRCalifornia Department of Corrections and Rehabilitation facility (e.g. escape pursuit and transportation/hospital custody, etc.) and supervised persons, appropriately trained and equipped CDCRCalifornia Department of Corrections and Rehabilitation peace officers can be authorized to act outside of normal duties during emergency and non-emergency situations as specified by law. Any assistance provided shall be in accordance with the peace officers’ CDCRCalifornia Department of Corrections and Rehabilitation training (e.g. if not trained in entry operations or negotiations, they shall not participate in that capacity).

A CDCRCalifornia Department of Corrections and Rehabilitation peace officer has authority that extends to any place in the State while engaged in the performance of the duties of their respective employment and for the purposes of carrying out the primary function of their employment or as required under Sections 8597, 8598, and 8617 of the Government Code (GCGovernment Code).

CDCRCalifornia Department of Corrections and Rehabilitation peace officers whose authority is designated by PCPenal Code 830.2(d)(1) & (2), are exempt from the requirements outlined in 51010.5 and 51010.6 (b).
51010.4 Emergency Assistance

When a government agency (city, county, state, federal) makes an emergency mutual aid request that meets the criteria contained in the State Mutual Aid Plan or the Law Enforcement Mutual Aid Plan, response protocol provided in these plans shall be followed and the requesting agency shall make the request through the California Office of Emergency Services (CalOES).

Once a CDCRCalifornia Department of Corrections and Rehabilitation office or institution is aware of a mutual aid request received from another government agency, they shall contact the OCSOffice of Correctional Safety duty officer for tracking.

If contacted directly by another government agency for mutual aid but the request has not yet been vetted through the CalOES Law Enforcement Branch first, the requested CDCRCalifornia Department of Corrections and Rehabilitation office or institution shall inform the OCSOffice of Correctional Safety duty officer and redirect the requesting agency to CalOES.

GCGovernment Code Section 8597 authorizes that when the appropriate state official proclaims a state of emergency or when a state of war emergency exists, PCPenal Code Section 830.5 peace officers have full powers and authority as outlined in PCPenal Code Section 830.1. Criteria for activation of these plans include, but are not limited to, disasters which may result from flood, fire, earthquake, war, sabotage, or riots.

GCGovernment Code Section 8598 authorizes that when a local emergency exists, PCPenal Code Section 830.5 peace officers have full powers and authority as outlined in PCPenal Code Section 830.1.

When acting as peace officers under PCPenal Code Section 830.1, peace officers are authorized to exercise any powers which are appropriate or which may be directed by their superior officers.
51010.5 Non‑Emergency Assistance (General Law Enforcement Assistance)

GCGovernment Code Section 8617 provides that the CDCRCalifornia Department of Corrections and Rehabilitation may exercise non-emergency mutual aid powers in accordance with the Master Mutual Aid Agreement and local ordinances, resolutions, agreements, or plans.

CDCRCalifornia Department of Corrections and Rehabilitation peace officers may be approved to assist law enforcement agencies during non-emergency situations if one or more of the following exist:

The request has a direct nexus to CDCRCalifornia Department of Corrections and Rehabilitation.

The request complies with a signed Memorandum of Understanding.

Mutual Aid Agreement.

51010.6 Provision of Assistance in Emergency and Non‑Emergency Situations

CDCRCalifornia Department of Corrections and Rehabilitation hiring authorities (e.g. Wardens, Assistant Deputy Directors) are authorized to provide CDCRCalifornia Department of Corrections and Rehabilitation peace officer assistance to law enforcement agencies in emergency and non-emergency situations as consistent with the authority discussed herein.

Hiring authorities shall notify their supervisors of provision of assistance (e.g. Wardens shall notify their Associate Directors) prior to authorizing the assistance.

When CDCRCalifornia Department of Corrections and Rehabilitation peace officers are assigned to provide emergency or non-emergency law enforcement assistance, these tasks become the primary function of their employment for the duration of the assignment. Unless other agreements have been made, all costs associated with this assistance are the responsibility of CDCRCalifornia Department of Corrections and Rehabilitation.
51010.7 Emergency Assistance Cost Recovery

During an incident that has either received a State Proclamation from the Governor or a Federal Declaration from the President of the United States, requesting agencies shall follow the mission tasking process through CalOES. This process requires the requesting agency to submit their request to the State Operations Center to be processed and sent to the OCSOffice of Correctional Safety for fulfillment. This process provides the required documentation for cost recovery.

During smaller incidents that have not initiated a State Proclamation or Federal Declaration, the mission tasking process shall still be followed, and OCSOffice of Correctional Safety shall be notified, however, the assisting agency may not receive reimbursement for assistance provided.

If a CDCRCalifornia Department of Corrections and Rehabilitation office or institution provides mutual aid to a requesting agency without a mission task or formal agreement, they may not receive reimbursement for the assistance provided.
