14010.19.1 Filing Fee for Incarcerated Persons to Initiate State Civil Actions

Statute and regulations require the Secretary to collect a $3.00 filing fee, separate from any other fees required from the court, for each state civil action initiated by incarcerated persons while incarcerated with the department. Civil actions are defined as non-criminal.

The fee is to be charged to the incarcerated person’s trust account. Incarcerated persons shall fill out a CDCRCalifornia Department of Corrections and Rehabilitation Form 193, Trust Account Withdraw Order, specifically identifying the purpose of the withdrawal, the parties associated with the action, and the court where the filing is to be sent. The CDCRCalifornia Department of Corrections and Rehabilitation Form 193 shall be processed in the trust office, marked “PAID,” and signed by the trust staff deducting the $3.00 filing fee from the trust account. If the incarcerated person trust account does not have $3.00 available to pay the filing fee, the CDCRCalifornia Department of Corrections and Rehabilitation Form 193 shall be marked “NSF” to reflect that funds were not available to pay the filing fee.

Incarcerated persons shall not handle a completed CDCRCalifornia Department of Corrections and Rehabilitation Form 193. After the CDCRCalifornia Department of Corrections and Rehabilitation Form 193 has been marked “PAID” or “NSF,” it shall be provided to a designated staff member, who shall place it in the package in accordance with current legal mail procedures, prior to sealing and initialing of the envelope.
