14010.19 Incarcerated Person Access to Court

State and federal law guarantees incarcerated persons access to the courts to litigate issues. An incarcerated person may bring a lawsuit or be sued, like any other person.

No incarcerated person shall be disciplined or punished in any way for instituting or maintaining a lawsuit. Sanctions shall only be imposed by the courts, not by departmental employees, if an incarcerated person uses or abuses the right of access to the courts.
