Article 13 – CALPIA Inmate Hiring Requirements and Pay
51121.4.1 Minimum Intake Requirements

Inmates applying for a job, apprenticeship, or training position with CALPIACalifornia Prison Industry Authority (formerly PIA) must have a minimum of two (2) years and a maximum of five (5) years from their Earliest Possible Release Date (EPRDEarliest Possible Release Date), on the date of application.

Exemption: Institution Wardens, CALPIACalifornia Prison Industry Authority (formerly PIA) Administrators, or Lead Managers with transient populations where inmate availability deficiencies are statistically substantiated by virtue of individual missions may use an alternate intake requirement after obtaining a written waiver authorization from CALPIACalifornia Prison Industry Authority (formerly PIA) General Manager annually.

Institutions which receive this authorization will be allowed to utilize the following alternate intake requirement:

Inmates applying for a job, apprenticeship, or training position with CALPIACalifornia Prison Industry Authority (formerly PIA) must have a minimum of two (2) months and a maximum of 60 months from their Earliest Possible Release Date (EPRDEarliest Possible Release Date), on date of application.

Eligible inmates must meet the minimum qualifications to perform the essential job functions.

Assigned inmates must complete their GEDGeneral Education Development or High School diploma within two years of initial CALPIACalifornia Prison Industry Authority (formerly PIA) assignment unless that is not feasible due to disabling conditions documented in the inmate’s C-File, in which case the inmate worker must be concurrently enrolled in classes to obtain a GEDGeneral Education Development or high school diploma while in a work assignment with CALPIACalifornia Prison Industry Authority (formerly PIA). Failure to obtain GEDGeneral Education Development equivalences or High School diploma may result in the inmate’s immediate un-assignment from CALPIACalifornia Prison Industry Authority (formerly PIA).

Americans with Disabilities Act of 1990 (ADAAmericans with Disabilities Act) Exemption. Institution Wardens, CALPIACalifornia Prison Industry Authority (formerly PIA) Administrators, or Lead Managers will make a good faith effort and may accommodate inmates with disabilities unless it can be demonstrated that such accommodation would fundamentally alter the nature of the program or result in an undue financial and administrative burden, or unsafe working conditions for CALPIACalifornia Prison Industry Authority (formerly PIA). Assigned inmates must be able to perform the essential functions of the duties of the position with or without reasonable accommodations.

The total number of inmates with life sentences assigned to CALPIACalifornia Prison Industry Authority (formerly PIA) programs at an institution must not exceed 25 percent of the established workforce allocation per CALPIACalifornia Prison Industry Authority (formerly PIA) Enterprise. This percentage will not necessarily achieve parity with the institution’s yard housing these inmates or the overall institution’s lifer population make up.

Exemption: Institution Wardens, CALPIACalifornia Prison Industry Authority (formerly PIA) Administrators, or Lead Managers with life sentence populations where inmate availability deficiencies are statistically substantiated by virtue of individual missions must obtain an annual waiver authorization exempting them from the 25 percent cap from CALPIACalifornia Prison Industry Authority (formerly PIA) General Manager.

This authorization will allow institutions to exceed the 25 percent cap in order to provide CALPIACalifornia Prison Industry Authority (formerly PIA) the necessary manpower needs.

Immigration and Customs Enforcement (ICE) Hold inmate workers who have not been lawfully admitted for permanent residence within the U.S.United States at the time of incarceration may be assigned to a CALPIACalifornia Prison Industry Authority (formerly PIA) job training assignment; however, they will not be eligible to receive external accredited certificates through CALPIACalifornia Prison Industry Authority (formerly PIA). ICE Hold inmate workers who are in the process of acquiring an external certification or have had their ICE Hold status removed through administrative proceedings will be allowed to continue and finish such external certification.
