54100.13.3 Third Level

The third level constitutes the Department Secretary’s decision on an appeal, and shall be conducted by a designated representative of the Secretary under the supervision of the third level Appeals Chief. The third level of review exhausts administrative remedies; however, this does not preclude amending a finding previously made at the third level. Administrative remedies shall not be considered exhausted relative to any new issue, information or person later named by the appellant that was not included in the originally submitted CDCRCalifornia Department of Corrections and Rehabilitation Form 602 and addressed through all required levels of administrative review (up to and including the third level, unless the third level of review is waived by regulation).
